This website is operated by Mirror Mirror Australia Pty Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Mirror Mirror Australia Pty Ltd. Mirror Mirror Australia Pty Ltd offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

1. ORDERS
1.1 An order is not confirmed or accepted until 'Order Confirmation' email has been received, or until you are provided with a physical invoice in-store. 

1.2 Pricing may vary on orders placed online compared to in-store.

1.3 Once an order has been confirmed by us, it cannot be cancelled. 

1.4 If an order cannot be fulfilled within a reasonable timeframe, or at all, a full refund of funds will be offered. 

1.5 For all 'Made to order' mirror orders, the following conditions apply: 

(a) A difference of 3mm either way of the ordered size should be allowed by the customer;

(b) A lead-time of 1-2 weeks. 

1.6 For all 'Custom' mirror orders, the following conditions apply 

(a) A difference of 3mm either way of the ordered size should be allowed by the customer; 

(b) A lead-time of 2-3 weeks.

1.7 All information provided on our website is believed to be correct as of the date it was submitted online. However, we do not guarantee the availability of any products or services displayed on our website. 

2. PRODUCTS 

2.1 All information provided on our website is believed to be correct as of the date it was submitted online. However, we cannot guarantee that information is always accurate or up to date. 

2.2 We endeavour to provide the most accurate colour descriptions of our products, along with accurate photography. In some cases, slight variations may occur due to the settings and calibration of your particular viewing device. 

2.3 All descriptions of our products with regards to their 'Size', 'Frame Width', 'Frame Depth', 'Construction' and 'Weight' are approximate and are provided for reference only. 

2.4 Variations to colour and size are especially common in products described as 'hand made', 'hand crafted' or 'custom'.

3. DELIVERY AND SERVICES

3.1 We will always endeavour to provide a timely and professional delivery service. Some factors outside of our control can impact our delivery service and cause unforeseen delays that we will not be held accountable for. These factors include, but are not limited to: 

(a) The Coronavirus Pandemic;

(b) unforeseen weather events;

(c) staff illness;

(d) staff shortages; 

(e) mechanical issues. 

3.2 All delivery date lead times should be treated as approximate and are provided for reference only. 

3.3 Any information provided by us to a customer regarding delivery lead times will have been provided to us from a third party, therefore we cannot guarantee the accuracy of this information. 

3.4 Our third party delivery partners will not (unless otherwise specified): 

(a) bring products up stairs; 

(b) take products into elevators; 

(c) move furniture in order to make a delivery; 

(d) attempt delivery if pets are loose; 

(e) unpack products or remove rubbish; 

(f) install products. 

3.5 In some circumstances delivery partners may not be able to contact you prior to delivery. 

3.6 We will always endeavour to select the most suitable delivery partner for each order. In some cases, this may mean products being delivered by a third party that is alternative to the one that was listed in your checkout. 

3.7 We will not delivery products to PO Box addresses.

3.8 Some areas are not covered by our delivery service. 

3.9 We will not deliver to any postal addresses outside of Australia.

3.10 All Installation Contractors that appear on our website and in-store are independent contractors. It is the sole responsibility of the customer who decides to engage a contractor to do their due diligence, and ensure that the selected contractor is suitably skilled and insured. We will not be held in any way accountable for any personal injury or death to you or any third person, or for any special, direct, indirect or consequential loss or damage arising out of your engagement with any of these contractors. 

4. ACCURACY OF BILLING AND ACCOUNT INFORMATION
4.1 We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

4.2 You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

5. PAYMENT 

5.1 Payment for all orders will be processed immediately at the time they are placed. 

5.2 By placing an order and using a payment method, you agree to the terms and conditions of the respective payment method you have selected. 

5.3 Products described as 'In stock' require payment in full for an order to be placed. 

5.4 Products described as 'made to order' require payment in full for an order to be placed. 

5.5 Products described as 'custom size' require payment in full for an order to be placed. 

5.4 Products described as 'available for pre-order' or 'backordered' require (at a minimum) payment of a 50% deposit for an order to be placed.

7. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
7.1 We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
7.2 You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Mirror Mirror Australia Pty Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

8. EXCHANGES AND RETURNS

8.2 We do not offer 'change of mind' refunds.

8.3 We offer a 14 day Exchange Policy on all products, besides 'custom made' mirrors (unless otherwise specified). 

8.4 To be eligible for our Exchange Policy: 

(a) product(s) have to be initiated for exchange within 14 days of pick up / delivery;

(b) product(s) have to be initiated for exchange prior to installation / alteration of hanging fittings; 

(c) product(s) must be in original condition, with all of their original packaging. 

8.5 Products can be exchanged for: 

(a) another product of equal value;

(b) another product of greater value (with the difference being paid by you); 

(c) a store credit / credit note (valid for 12 months);

(d) another product of lesser value (in combination with a store credit / credit note).

8.6 All exchanges may be subject to the associates delivery fees. These fees may not be the same as placed on your original order.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
